PRIVACY POLICY 

Terms & Conditions – United Performance Hub / United Training Grounds

1. Acceptance (a) This Agreement is between United Performance Hub / United Training Grounds PTY LTD (ABN 18 651 050 690) (we, our or us) and you, the individual or entity purchasing any Products, Services or Goods (Services) from us through our website or associated platforms.

(b) By purchasing any Services from us, you agree:
(1) that you have read, understood, and accept these Terms and Conditions;
(2) that you have the legal capacity to enter into a legally binding agreement with us;

(c) You must be at least 18 years of age to purchase Services.

2. Account Holders
(a) You may be required to create an account to access certain services. Account setup includes providing personal information, contact details, and payment details.

(b) You must ensure the accuracy of the information provided and keep it up to date.

(c) You are responsible for all activity under your account.

(d) A health screening form may be required prior to service commencement.

3. Orders & Subscription Services
(a) All coaching services, including training and nutrition programs, are delivered via subscription.

(b) Nutrition coaching has an 8-week minimum commitment.

(c) Subscriptions are billed weekly, with the billing cycle running Monday to Sunday.

(d) 2 weeks’ written notice is required for all subscription cancellations. Services will remain active during this period.

(e) You may upgrade your subscription at any time. Downgrades are only permitted after the minimum commitment period.

4. Pricing & Payments
(a) All prices are listed in AUD and inclusive of GST (if applicable).

(b) Payments are collected via direct debit. You must maintain an active payment method.

(c) If payment fails, services may be paused until payment is made.

(d) Non-payment beyond 7 days may result in cancellation of services and recovery of outstanding fees including collection costs.

5. Refunds & Holds
(a) No refunds are offered for change of mind once onboarding has begun or services are delivered.

(b) Plans may be placed on hold for up to 4 weeks, once per 12-week cycle, provided you are not within a challenge period or minimum commitment.

(c) Once-off plans and digital products are non-refundable once created.

6. Cancellations
(a) Cancellations must be submitted via email.

(b) Your subscription will continue for 14 days from the date of cancellation notice.

(c) No cooling-off period applies.

7. Australian Consumer Law
Nothing in these Terms excludes your rights under Australian Consumer Law. If there is a major fault with our service, you are entitled to a remedy.

8. Limitations of Liability
(a) Our liability is limited to the amount paid by you for the service in question.

(b) We are not liable for indirect loss, including loss of profits or personal injury caused through misuse or neglect of the coaching materials.

9. Privacy & Data Use
(a) We collect personal information for service delivery and communication purposes.

(b) Your data may be shared with trusted third parties as needed to deliver services.

(c) By engaging our services, you consent to this data use.

10. General
(a) These Terms are governed by the laws of Victoria, Australia.

(b) We may update these Terms from time to time. Updated versions will be posted on our website.

(c) Disputes will be handled via negotiation and mediation prior to legal proceedings.
